By creating an account or using embden ("the app," "we"), you agree to these terms. If you don't agree, don't use the app.

What the app does

embden shows estimated crowd levels at venues, built from a mix of historical modeling, third-party occupancy signals, and reports submitted by other users. These are estimates, not guarantees. A venue can be busier or quieter than shown at any given moment, and we're not responsible for a trip that doesn't match what the app predicted.

Eligibility and accounts

• You must be at least 16 years old to use embden. We ask for your date of birth at registration to verify this, and providing a false date of birth is grounds for account termination.
• You're responsible for keeping your login credentials secure and for anything that happens under your account.
• One account per person. Don't create accounts to evade a ban or to submit reports you couldn't legitimately make yourself.

Community content and conduct

Crowd reports, votes, "confirmed accurate" taps, and feedback you submit are your own contributions, and we rely on them being honest. You agree not to:

• Submit a report for a venue you weren't actually at, or otherwise falsify occupancy data.
• Harass, impersonate, or post abusive content about another user or a business.
• Post objectionable content anywhere in the app, whether in a report, a take, a username, a message, or a business's photos, events and offers. That includes hate speech, harassment, threats, sexual content, and anything that demeans a person or a group.
• Scrape, reverse-engineer, or bulk-extract data from the app outside normal use.
• Interfere with the app's operation (rate-limit evasion, automated report submission, etc.).

We have zero tolerance for objectionable content and abusive users. You can report a post or a listing from inside the app, and block the person who wrote it. We review every report within 24 hours. Content that breaks these terms is removed, and the account that posted it is suspended or closed.

We may also remove content, disable the ability to report, or suspend or terminate an account that violates these terms, with or without notice.

Business accounts

• Claiming a business listing means you're representing that you're authorized to manage that venue's information on its behalf. A false claim can be rejected or reversed at any time.
• Premium is a paid subscription, on the cycle shown at checkout. If you subscribed through the iPhone app, billing runs through the App Store. Cancel any time from your Apple ID's subscription settings, and any refund is handled by Apple under Apple's own policies, not by us. If you subscribed another way, billing runs through Stripe. Cancel any time by contacting us; canceling stops future billing but doesn't refund the current period unless we say otherwise.
• Owner-provided information (hours, contact info, wait time, "verified live count," etc.) is your responsibility to keep accurate. We display what you enter as-is.

Recognition

Any recognition the app records for taking part, such as a count of the reports you've filed, has no cash value, can't be transferred, and isn't redeemable for money. We can change or remove it at any time.

Third-party services

The app links out to or relies on services we don't control: Google, Visual Crossing, SeatGeek, BestTime.app, Stripe, Apple, Amazon Location Service (opening hours for some places), and SpotHero among them (see the Privacy Policy for what each does). Your use of those services is governed by their own terms, not ours. If you subscribe to Premium through the iPhone app, Apple's own Media Services Terms and Conditions also apply to that purchase.

Intellectual property

"embden" and its logo are trademarks of Introvert Labs LLC. You keep ownership of the content you submit (reports, feedback, etc.), but by submitting it you give us a license to display, store, and use it to operate and improve the app.

Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, timely, secure, or error-free. We don't guarantee the accuracy of crowd estimates, weather data, event listings, hours, or any other information shown, whether it comes from us, a business, another user, or a third-party provider.

Crowd estimates and related information are for general planning purposes only. They are not a substitute for your own judgment, for confirming directly with a venue, or for any decision involving your personal safety. Don't rely on them for that.

Assumption of risk

Any decision you make based on information in the app, including whether and when to travel to a venue, is yours alone and at your own risk. We aren't a party to, and take no responsibility for, what happens at a third-party venue.

Limitation of liability

To the fullest extent the law allows, Introvert Labs LLC isn't liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the app, including a wasted trip, a missed event, or any personal injury or property damage claimed to result from acting on an estimate or other information the app displayed, even if we've been advised the loss was possible.

To the extent any liability isn't excluded above, our total liability for any claim relating to the app is capped at the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100 USD.

Some jurisdictions don't allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you in full. In that case, the exclusion/limitation applies to the fullest extent that jurisdiction allows.

Termination

You can delete your account at any time from Settings. We can suspend or terminate access for violating these terms or for abuse of the platform.

Changes to these terms

If these terms change in a meaningful way, we'll update the effective date above.
